student-athletes joining the team this semester,
please contact compliance services and schedule a time for the students to
complete their compliance paperwork.
A
special welcome to our new football coaches: Marion Hobby (defense), Vic
Koenning (defensive coordinator) and Rob Spence (offensive coordinator).
We
need your help! Some student-athletes
are paying miscellaneous fines with a credit card. There is a $45 charge applied when using a
credit card. A $10 fine becomes a $55
cost. Please advise student-athletes to
pay with cash!
The
ACC office has asked that we remind non-coaching personnel (e.g., directors of
operation, managers) that they may not be involved in any activities during
practice and competitions that could be considered coaching (See NCAA Bylaw
11.7.1.1.1.1). This is not an issue at
Clemson thanks to our staff members serving in those positions who honor
legislation.

Violations: Ethical conduct, recruiting, impermissible
telephone contact, impermissible extra benefits, failure to monitor.
Penalties: Public reprimand and censure, three years of
probation, one year ban of off-campus recruiting, reduction of financial awards
from 13 to12 in 2005-06 and 13 to 11 for 2006-07, reduction of official expense
paid visits from 12 to 9 for the next three academic years.
Lessons
Learned: Providing
benefits to any individual involved in teaching or directing prospects is
impermissible. Coaches must have
permission to speak before contacting 4-year college prospects. Athletic staff members and their spouses are
prohibited from providing gifts to prospects.
It is not permissible to post bail for prospects.
Involved
Sport(s): Football
Violations:
Improper recruiting contacts and inducements and unethical
conduct.
Penalties:
Public reprimand and censure, four years probation, postseason
ban, limit of 81 total grants for 2005-06 and 2006-07, official expense paid
visits limited to 45 for 2004-05 and 2005-06 with no “banking” of unused visits
and two assistant coaches receiving a two-year show cause provision.
Lessons
Learned: Student-athletes serving as host that they can
not give cash to prospects on an official visit. Free lodging on unofficial visits is
impermissible on- or off-campus.

Tennis
Violations:
Recruiting, extra benefits and unethical conduct.
Penalties:
Public reprimand and censure, extension of one year to the probation period
imposed from 2002, head coach given option to resign or be dismissed (head
coach resigned), team required to decreased its practice time by one week and
head coach given a five-year show cause provision.
Lessons
Learned: You must educate coaches on the
rules! It
is unethical to provide false and misleading information during an
investigation. Prospects on official
visits may not travel with a team to an away-from-home contest. Prospects can not try-out for Division I
teams.

Violations:
Gambling, recruiting and failure to monitor.
Penalties:
Public reprimand and censure, extension of probationary period until 2007,
official expense paid visits limited to 48 for both 2004-05 and 2005-06 and
university prohibited from using water craft as transportation or entertainment
for recruits during 2004-05 and 2005-06
Lessons
Learned: Gambling
is not just an issue with student-athletes.
Gambling legislation applies to all athletic department staff members.
Prospects can’t mingle with boosters on unofficial or official visits. Rental costs should be deducted from
entertainment money for prospects entertained with boats or jet skis. Official
visit activities need approval!

from coaches or athletic department staff members?

NO. NCAA Bylaw 16.02.3 does not permit
staff members or their spouses to give student-athletes gifts that are not

visit in the coaches’ office for the prospect to see when they meet with the

Personalized recruiting aids are prohibited during an official or
unofficial visit. This includes any decorative items and special additions to
any location the prospect visits.
Everywhere a prospect visits should be maintained in the same manner as
